Right of withdrawal

Instruction on the right to withdraw from the contract

  1. If the customer is a consumer (in the sense of the Consumer Protection Act), he has the right to withdraw from the contract concluded by Istac Promotion GmbH for the Schwarzmüller Merchandising Shop within fourteen days without giving reasons, unless it is a custom-made product made according to the customer's individual wishes to resign.
  2. The cancellation period is fourteen days and begins:
    • in the case of a purchase contract, on the day on which the customer or a third party (not including the carrier) designated by the customer takes possession of the ordered product
    • if the customer has ordered several products as part of a single order, which are delivered separately, on the day on which the customer or a third party designated by the customer (not including the carrier) takes possession of the last product;
    • in the case of delivery of goods in several partial shipments, on the day on which the customer or a third party named by the customer (this does not mean the carrier) take possession of the last partial shipment or the last piece;
  3. The customer can exercise his right of withdrawal by means of a clear declaration in which Istac Promotion GmbH is informed of the decision to withdraw from the contract.
  4. This can be done:
    • via the Schwarzmüller Merchandising Shop
    • by post: Istac Promotion GmbH, Titanstraße 3, 4062 Kirchberg-Thening

    • by telephone: +43 (0) 7221 63760-0
  5. The customer can use the cancellation form provided by Istac Promotion GmbH in the fan shop for printing, but this is not absolutely necessary.
  6. In order to meet the cancellation deadline, it is sufficient for the customer to send the declaration regarding the exercise of the right of cancellation before the deadline expires.
  7. If the customer withdraws from the contract, Istac Promotion GmbH will refund the payments already made immediately, but at the latest within 14 days of receipt of the declaration of withdrawal. However, this does not apply if the purchase price has not been credited to Istac Promotion GmbH's account when paying on account; in this case there is no right to repayment.
  8. This reimbursement includes the gross price paid by the customer for the product, including the delivery costs for transporting the product to the customer. Any additional costs will not be reimbursed.
  9. The repayment can be refused by Istac Promotion GmbH until Istac Promotion GmbH has received the product back or until the customer provides proof that he has sent the product back (whichever is the earlier).
  10. If the customer withdraws from the contract, he is obliged to return the received product to Istac Promotion GmbH immediately, but no later than 14 days after submitting the declaration of withdrawal (unless Istac Promotion GmbH has offered the customer in writing to collect the goods himself ). This return period is met if the product is dispatched within the period.
  11. The direct costs of returning the product are to be borne by the customer.
  12. The customer must pay Istac Promotion GmbH compensation for any loss in value if this is due to handling that is not necessary to establish the nature, properties and functioning of the product.

Exceptions to the right of withdrawal

The right of withdrawal described does not apply, among other things, to customers who are consumers for:

  • Goods that are made to customer specifications or are clearly tailored to personal needs,
  • Goods that can spoil quickly or whose use-by date would soon be exceeded,
  • Newspapers, periodicals or magazines with the exception of subscription contracts for the delivery of such publications,
  • Audio or video recordings or computer software (such as CD, DVD, CD-ROM) supplied in sealed packages and unsealed by the customer.

If the right of withdrawal does not exist, Istac Promotion GmbH will explicitly inform the customer of the non-existence before the contract is concluded.
